Work based, or employment based immigrant visas are divided into two categories: those that require employer sponsorship, and those that do not.  There are two types of self-sponsored applications: Extraordinary Ability (available for scientists and artists) and National Interest Waiver (available for scientists only). Both of them require a showing of substantial impact in your field of work.  There are also two options available for employer-sponsored applications. First, the employer can advertise the position and see if there are any qualified U.S. Citizens or Permanent Residents. If not, then you get what is called a Labor Certification (PERM). The other options, the Outstanding Researcher, while requires employer sponsorship, it does not require labor certification. This application can be very beneficial as it is easier than the Extraordinary Ability or National Interest Waiver, but much quicker than the Labor Certification. It is also current for those people from India and China.   

O Visa is a non-immigrant visa available to highly talented or nationally or internationally acclaimed artist.  O Visa is given for a three-year period and can be renewed after the expiration of the three years.  O Visa can also be a good option for scientists as a flexible alternative to the H-1B program as there is not minimum wage requirement, no limit on time in classification and no cap.
